1. Introduction

Welcome to the Taily app ("App"). These Terms of Use govern your use of our mobile application for creating personalized children's stories using artificial intelligence.

By using the App, you agree to these Terms of Use ("Terms"). Please read them carefully before using the App. If you do not agree to these Terms, you may not use our App.

2. Acceptance of Terms

By downloading, installing, or using the Taily App, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must stop using the App and uninstall it from your device.

3. Changes to Terms

We may periodically update these Terms by posting an updated version in the App. We will notify you of any material changes through:

  • In-app notifications
  • Email messages to the address associated with your account
  • App store updates

4. Account Registration and Subscription

4.1 Account Registration

To use the full functionality of the App, you must create an account. By registering, you agree to provide accurate information, including:

  • Email address
  • Child's name and age
  • Child's interests
  • Other profile information

4.2 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account access data
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account

4.3 Account Deletion

You may delete your account at any time in the App settings or by contacting our support team. After account deletion:

  • Your personal data will be deleted in accordance with our Privacy Policy
  • Access to the App will be immediately terminated
  • Unused portion of subscription may be refundable according to app store policies

5. Subscription and Payments

5.1 Subscription Model

The App offers both free and paid features in a subscription model. Premium offers:

  • Unlimited personalized story generation
  • Professional audio narration
  • Advanced personalization features
  • Access to all story categories

5.2 App Store Payments

  • All payments are processed through Apple App Store or Google Play Store
  • Charges are made according to the respective app store policies
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

5.3 Free Trial Period

  • New users may access a free trial period
  • Cancelling during the trial period prevents charges
  • After the trial period ends, the subscription will automatically renew

5.4 Subscription Cancellation

  • Subscriptions can be cancelled in app store settings (App Store or Google Play)
  • Cancellation stops future payments but does not affect the current billing period
  • Access to Premium features remains active until the end of the paid period

6. Usage Rules

6.1 Permitted Use

You agree to use the App exclusively:

  • For personal, non-commercial purposes
  • To create stories for children in your family
  • In accordance with applicable laws
  • In a manner appropriate for a family app

6.2 Prohibited Activities

You agree not to:

  • Use the App in a way that violates any applicable laws
  • Create inappropriate content for children
  • Share your account access data with others
  • Attempt to gain unauthorized access to systems
  • Upload materials containing viruses or malicious software
  • Copy, modify, or create derivative works of the App
  • Use the App for commercial purposes without consent

6.3 AI-Generated Content

  • The App uses artificial intelligence to generate stories
  • We do not guarantee that all generated content will be perfect
  • We encourage checking content before reading to children
  • We reserve the right to moderate and filter content

7. Intellectual Property Rights

7.1 App Rights

All intellectual property rights to the App (including code, graphics, AI algorithms) belong to us or our licensors.

7.2 User License

You receive a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.

7.3 User Content

  • You retain rights to content you create in the App
  • You grant us a license to process that content to provide services
  • You may delete your content according to App features

8. Child Safety

8.1 Family App

  • The App is designed to be safe for children
  • We do not collect children's personal data without parental consent
  • All content is moderated for child appropriateness

8.2 Parental Supervision

  • Parents are responsible for supervising children's use of the App
  • We encourage reading generated stories together
  • Parents can control App features in settings

8.3 COPPA Compliance

The App complies with the Children's Online Privacy Protection Act (COPPA) and does not knowingly collect personal data from children under 13 without parental consent.

9. App Features

9.1 AI Story Generation

  • The App creates personalized stories based on child preferences
  • Stories are generated in real-time
  • We do not guarantee 24/7 service availability

9.2 Audio Narration

  • Premium feature offers professional audio narration
  • Audio is generated using text-to-speech technology
  • Audio quality may vary depending on content

9.3 Story Saving

  • You can save favorite stories in the App
  • Saved stories are available offline
  • Number of saved stories may be limited in the free version

10. Availability and Support

10.1 App Availability

  • We strive to ensure continuous App availability
  • Temporary unavailability may occur due to maintenance
  • We do not guarantee uninterrupted availability of AI services

10.2 Technical Support

  • Support is available via email: support@tailyapp.io
  • Response time is up to 48 hours on business days
  • Support covers technical issues and account questions

10.3 App Updates

  • We regularly release App updates
  • Updates may contain new features and fixes
  • We recommend maintaining the current App version

11. Limitation of Liability

11.1 AI-Generated Content

  • We are not responsible for all content generated by AI
  • Users should check content before sharing with children
  • AI may sometimes generate unexpected content

11.2 Limitation of Damages

We will not be liable for:

  • Any indirect or consequential damages
  • Loss of data or interruption in App use
  • Problems arising from app store operations

11.3 Maximum Liability

Our total liability is limited to the amount paid for subscription in the last 12 months.

12. Termination

12.1 Termination by User

You may at any time:

  • Cancel subscription in the app store
  • Delete account in App settings
  • Uninstall the App from your device

12.2 Termination by Us

We may suspend or terminate access to the App in case of:

  • Violation of these Terms
  • Actions harming other users
  • Non-payment of subscription

13. App Store Compliance

13.1 Apple App Store

Use of the App on iOS devices is also subject to Apple App Store Terms of Service.

13.2 Google Play Store

Use of the App on Android devices is also subject to Google Play Store Terms of Service.

13.3 Store Responsibility

App stores are not responsible for the App, its content, or technical support.

14. Governing Law

14.1 Polish Law

These Terms are governed by and construed in accordance with Polish law.

14.2 Dispute Resolution

All disputes will be resolved by the appropriate court in Poland, subject to mandatory consumer jurisdiction provisions.

16. Final Provisions

16.1 Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement regarding use of the App.

16.2 Severability

If any provision is deemed invalid, the remaining provisions remain in effect.
